House Bill 799 is a bill pending in the Georgia Legislature which will allows for a DUI conviction to be expunged if the individual convicted does not violate any traffic laws for five years upon his or her arrest for DUI. Currently, there is no opportunity to expunge a DUI conviction.

This bill makes sense. Those that are convicted of a DUI but show a pattern of subsequent good driving behavior should be allowed to get their DUI conviction removed from their record. One of the worst consequences of a DUI conviction is that it follows you forever and can impact on an your employment opportunites in the future. If you or someone you know is facing DUI charges, you need a lawyer who understands these consequences and will fight to keep your record clean. Contact the Law Offices of Howard J. Weintraub, P.C. to speak with an attorney today!

Last week, Governor Nathan Deal signed into law Senate Bill 236 which reduces the Drivers License suspension for individuals convicted of a second DUI offense within a five year period. Senate Bill 236 reduces the 12 month license suspension period to a four month suspension if approved by the court and if the individual installs an ignition interlock device.

This law is good news for those finding themselves charged with DUI offenses in Georgia. Often the harshest penalties facing individuals charged with DUI are the mandatory license suspensions associated with DUI convictions. These suspensions can greatly impact on an individuals ability to obtain and maintain employment. Therefore, if you or someone you know is charged with a DUI offense in Georgia, it is important to hire an attorney that knows all of the potential consequences of a DUI conviction and can fight to protect your license.

In a fascinating case that sheds light on the shadowy world of international computer crime, seven individuals wereindicted in a complex scheme which involved the infection of half a million computers. Allegedly these individuals entered into agreements with website marketing agencies to receive money for the number of users that they were able to direct to certain websites. These individuals then allegedly infected the computers of unsuspecting individuals with malware that would force their computers to go to these specific sites when the users searched for the IRS or Apple iTunes websites. Complex computer crime charges are being brought more and more often by law enforcement these days. As such, any individual facing these charges must immediately seek the advice of an attorney who can understand the complex computer evidence in these cases and combat the government's highly trained computer experts. Contact the Law Offices Of Howard J. Weintraub immediately if you or someone you know may be faced with these types of charges.

As detailed in an article out from Reuters today, Dougherty County Superior Court Chief Judge W.E. Lockette today "issued a stay of execution for a convicted killer whose attorneys seek a new trial and additional DNA testing." Here is more:

Marcus Ray Johnson, 46, was scheduled to be put to death by lethal injection on Wednesday for the rape and murder of Angela Sizemore in Albany, Georgia in March 1994.

But Dougherty County Superior Court Chief Judge W.E. Lockette delayed the execution and set a hearing for February to determine the merits of Johnson's request for more DNA testing. Johnson's attorneys say the evidence that should be tested includes blood, saliva, hair, clothing and fingernail clippings.

Prosecutors said in court filings that Johnson's contentions had already been rejected by state and federal courts. The state said, at best, the DNA test results would prove Johnson was still guilty as a party to the crimes.

The FBI announced recently that they are creating a new task force to investigate corruption in Judges and legislators in Georgia. Citing increased instances of public corruption in the Georgia area, the FBI is now increasing its focus on public officials in Georgia. It is paramount that any individual contacted by the FBI or any law enforcement agency about public corruption charges contact an attorney immediately prior to speaking with authorities. High-profile investigations such as these tend to spiral and involve a vast number of private citizens only tangentially related to the public officials involved in the case. Anytime the FBI or law enforcement contacts you, immediately contact an attorney to protect your rights. Call the Law Offices Of Howard J.
Today, a New York Judge dismissed the remaining charges against French politician and International Monetary Fund Chief Dominique Strauss-Kahn. Strauss-Kahn was all but convicted in the court of public opinion at the outset of these charges. Almost everyone believed him guilty without knowing any of the relevant facts. This case highlights the devasting damage that charges like this can have on a person's reputation before any evidence is presented against them. When faced with these charges, many defendant's are immediately assumed guilty and can be abandoned by their friends and co-workers. However, individuals in this situation need not despair. Finding the right attorney to defend you, your family, and your reputation from the stigma associated with these types of crimes is the most important step you can take to reclaim your life and reputation. You need an attorney that believes in you and that has the steadfast determination to proclaim your innocence when everyone else is condemning you. Call The Law Offices Of Howard J. Weintraub today if you or someone you now needs the best defense possible from these charges.

Public School Cheating Scandal Widens

The State's investigation into cheating in Georgia's public schools is widening beyond Atlanta. However, in the midst of this scandal it is important to remember that there are a vast number of wonderful and perfectly innocent public school teachers who have taken part in no wrongdoing whatsoever. Public teachers are a national resource that deserve the presumption of innocence just like any other citizen. Any teacher that is contacted by investigators should seek the advice of an attorney before submitting to questioning and should have an attorney present should they choose to submit to such questioning. Even if an individual believes they have committed no crimes, it is always important to consult with an attorney prior to speaking with law enforcement. Contact the Law Offices Of Howard J. Weintraub immediately if law enforcement seeks to question you about anything.

Georgia Governor Nathan Deal's recent focus on illegal gambling operations suggests that many more arrests and prosecutions for these types of offenses will be coming in the near future. However, the laws in this area are complex and it is often difficult for individuals to distinguish between perfectly legal activities, such as some types of sweepstakes promotion, and illegal gambling. Given the complexities in this area of the law, anyone facing potential charges of illegal gambling needs to consult experienced attorneys that are familiar with these laws and how to represent individuals facing these charges. Contact the Law Offices of Howard J. Weintraub today if you or someone you know may be facing charges of illegal gambling.
