Penalties for Medical Marijuana Charges

In April 2015, legislators declared medical marijuana legal when if a physician has prescribed the drug. Called Haleigh's Hope Act, it was enacted to allow patients whose only source of life-saving treatment may be medical marijuana. However, the laws are still very restrictive. You can only possess a certain amount until the law decides that you are in violation.

The penalties for medical marijuana offenses may include:

  • 1 ounce or less for personal use:
    • 1 year incarceration
    • Up to $1, 000 fine
    • Driver's license suspension for 6 months
  • More than 1 ounce
    • Incarceration between 1 to 10 years
    • Up to $100, 000 in fines
    • Driver's license suspension for 6 months
