The Penalties of a DUI Conviction

If you have been arrested for DUI, then you may eventually be facing a criminal trial and risk the penalties of a DUI conviction. Driving under the influence of drugs and/or alcohol is a serious criminal offense that may be considered a misdemeanor or a felony depending on the circumstances of an incident. In any case, an individual who faces a DUI conviction is vulnerable to punishments that can have significant effects on their current and future opportunities.

Some of the common penalties for a DUI conviction include the following:

  • Suspension of your driver's license
  • Enrollment in substance abuse programs
  • Monetary fines of several thousand dollars
  • Jail time ranging from several months to several years
  • Driver's License Suspension & Restoration

One of the most damaging effects of DUI arrests and convictions is driver's license suspension. If you have been arrested for DUI or refused to submit to a breath test during the procedure, the law of implied consent (O.C.G.A. § 40-5-67.1) allows the arresting officer to automatically suspend your license and issue you a temporary driving permit. If your license is suspended during an arrest, you have 10 days following the incident to schedule an appeal hearing with the Georgia DDS.

If you fail to do this, your license will be automatically suspended for the duration of the period, which could be as long as 18 months! In addition, individuals may face license suspension as a DUI conviction punishment. This means that individuals may face license suspension twice for the same arrest incident. Each of these suspensions must be fought separately—appealing an automatic suspension with the Georgia DDS does not prevent license suspension after a criminal conviction.
