While Georgia DUI laws have always placed higher DUI penalties on individuals convicted for repeat DUI offenses, this new DUI statute places greater emphasis on penalty and reform for those who continue to get convicted for drunk driving. The "Look-Back" PeriodIn recent years, drivers were charged with repeat DUI if they had been convicted for drunk driving in the previous five years. Under the new DUI statute, effective for arrests made after July 1, 2008, the look-back period is increased to ten years. Essentially, this means that it is more difficult to be treated as a first-offender. Additionally, for individuals who have had three prior DUI convictions and are now facing a fourth offense DUI, will face felony charges and felony DUI penalties, if convicted.
