Underage DUI ∙ Under 21 DUI

In Georgia, underage drinking, and especially underage drinking and driving, is not tolerated. People who are under the age of 21 and are arrested for drunk driving may face two different DUI charges in Georgia:

  • Under 21 DUI per se: Georgia laws prohibit drivers under the age of 21 from driving within three hours from having blood alcohol content (BAC) levels as low as .02 grams (not the traditional .08 legal limit for people over 21). Essentially, what this means is that someone under 21 can be convicted for drunk driving after having one beer or less and driving afterwards.
  • Under 21 DUI less safe: Georgia laws prohibit underage individuals from driving if they are considered to be less safe driving after consuming alcohol than if they had not consumed alcohol or drugs.

Georgia underage drivers who are convicted for drunk driving with a BAC of .02 or higher (but less than .08) will face a license suspension of six months. Underage drivers convicted for drunk driving with a BAC of .08 or higher will have their license suspended for one year. Other DUI penalties are equal to penalties imposed on drivers over the age of 21.
