Penalties for Repeat Georgia DUI Offenses

The 10-Year DUI Look Back Period

In most states, receiving two or more DUIs within a certain period of time can result in harsher punishments. In Georgia, the "look back period" is 10 years—if you receive two or more DUIs within this length of time, you may be subject to additional punishments upon conviction. This includes increased fines, extended jail time, longer license suspension, and other penalties.

At The Law Offices of Howard J. Weintraub, P.C., our DUI lawyers in Atlanta have successfully handled thousands of DUI cases. With more than 55 years of legal experience, our firm has a valuable skillset that may help you pursue an effective course of legal action. As former prosecutors, our attorneys know that it pays to know both sides of the courtroom.

Second DUI Offense

If you are facing a second DUI conviction within 10 years of an earlier conviction, then the punishments you may receive are significantly harsher than the first DUI conviction. Minimum fines and minimum jail time are increased, as is the license suspension period. Although the penalties for this conviction may be more severe, a second DUI conviction still counts as a misdemeanor. Additional DUI convictions within 10 years may be considered more serious criminal offenses.

The punishments for a second DUI conviction include:

  • Jail sentence of 3 days to 1 year
  • Fines from $600 to $1,000
  • License suspension of 3 years
  • Community service for minimum of 240 hours

Third DUI Offense

A third DUI conviction within 10 years of two other DUI convictions is taken very seriously. Considered a "high and aggravated" misdemeanor, the punishments for this conviction are much more severe than a first or second DUI charge. If you are at risk for a third DUI conviction, it is important for you to seek counsel from an Atlanta DUI attorney. The circumstances of your arrest could have consequences you may not have expected.

The punishments for a third DUI conviction include:

  • Jail sentence of 120 days to 1 year
  • Fines from $1,000 to $5,000
  • License suspension of 5 years
  • Community service for minimum of 240 hours

Four or More DUI Offenses

Four or more DUI convictions within 10 years often result in a felony conviction. There are two major differences in punishment: you may face a jail sentence of one to five years, and your license may be suspended indefinitely. Our firm understands that the consequences of multiple DUI convictions are serious—contact us immediately and develop a plan of action with our DUI lawyer in Atlanta!

Protect your driving privileges and your future!

With each consecutive DUI conviction, the punishments become harsher, and the laws become more complicated. Depending on the circumstances of the arrest, such as if an accident occurred or someone suffered injuries in the process, a DUI conviction may result in a minor misdemeanor, or a felony charge. In addition, the number of DUI convictions you have does not necessarily determine whether you may petition the Georgia DDS for a temporary license. To increase your chances of protecting your rights and driving privileges, prepare a defense with The Law Offices of Howard J. Weintraub, P.C. fighting in your corner.

When it comes to a court defense, it pays to have former prosecutors who know both sides of the court room. Schedule a case consultation with our Atlanta DUI lawyers today!
