What penalties could I face?
The law defines child molestation as attempting to entice or coerce a person under the age of 16 to engage in sexual behavior or to arouse the interests of either that child or the offender.
For a first-time offender, under Georgia Title 16, §16-6-4, the penalties may be:
- Imprisonment between 5 to 20 years
- Mandatory counseling
For a second conviction, the prison sentence could be anywhere from 30 years to life. The state does have the obligation to inform the accused that he or she may face life imprisonment, should the case be brought to trial.
